Terms and Conditions
Last updated: 28 October 2026
This English version applies to customers who use the English website. It has the same content as the German version. If the two differ, the German version decides how a clause is to be read — unless the English wording is more favourable to you as a consumer, in which case you may rely on it.
1. Provider and scope
These terms govern the use of the software “PaceGuru” and the website paceguru.net. The provider is Dominik Binder – PaceGuru, Amelungenstraße 62, 96129 Strullendorf, Germany (“we”). The user is anyone who uses the software or the website (“you”).
Deviating terms of the user do not become part of the contract unless we expressly agree to their application.
2. Subject matter
PaceGuru is an overlay and analysis tool for the racing simulation iRacing. It displays comparison figures against a reference lap of your choosing, both while driving and in replay.
PaceGuru is an independent tool. It is not affiliated with, authorised by or endorsed by iRacing Motorsport Simulations, LLC.
3. Licence
We grant you a simple, non-exclusive, non-transferable right to use PaceGuru for your own purposes for the duration of your licence.
The following are not permitted:
- passing on, renting out or sub-licensing your licence key
- use of one licence key by several people
- circumventing or manipulating the licence check
- reverse engineering, except where expressly permitted by law
In the event of a serious breach we may block the licence key concerned and the associated account.
4. Account
You may create an account with an email address and a password. You are responsible for keeping your password secret and for choosing a password you do not already use elsewhere. If you suspect that third parties have gained access, change your password immediately — doing so automatically terminates all existing sessions.
You can delete your account yourself at any time. Deletion removes your account data immediately; details are in the privacy policy.
5. Plans, prices and launch offers
PaceGuru comes in two plans. Standard includes all overlays as well as joining teams and sharing laps (clause 7a). Team includes everything in Standard plus the right to open and run a team of your own and the Garage61 connection (clause 10). There is one contract per account: the Team price is the total price and is not charged on top of the Standard price.
Both plans are available as a monthly subscription or as an annual pass (clause 6). The prices are:
- Standard: for orders placed on or before 31 December 2026, as a launch offer, €1.99 per month or €19.99 for the annual pass. For orders from 1 January 2027, €2.99 per month or €29.99 for the annual pass.
- Team: for orders and plan changes on or before 30 April 2027, as a launch offer, €4.99 per month or €49.99 for the annual pass. After that, €9.99 per month or €99.99 for the annual pass.
Your price stays. A monthly subscription keeps the price at which it was started for as long as it continues without interruption – also beyond the end of a launch offer. If you order the same tariff again (same plan and same term) no later than 30 days after it ended, you get the price you last paid; this also applies to the annual pass, year after year. If more time has passed, or you choose a different tariff, the price shown on the website at that time applies.
6. Paid use, terms and cancellation
PaceGuru is used on a monthly subscription or with an annual pass. The following applies to paid contracts:
- The presentation on the website is not a binding offer but an invitation to make an offer. The contract is concluded when we confirm your order or provide access.
- The prices stated on the website at the time of ordering apply. They are final prices: under § 19 of the German VAT Act we do not charge VAT and do not show it on invoices.
- Monthly subscription: term of one month, renewing by one month at a time. You can cancel at any time with effect from the end of the current billing period. There is no minimum term and no notice period.
- Annual pass: a one-time payment for a fixed term of twelve months – not a subscription. It does not renew automatically: it ends when the twelve months are up, and nothing further is charged. If you want to carry on, you order again (for the price see clause 5). You can end it earlier at any time; we do not refund the remaining term unless clause 6a applies.
- Changing to the Team plan: with a running Standard monthly subscription or Standard annual pass you can change to the Team plan in your account, always within the same term (month to month, year to year). The change takes effect immediately. For the rest of the term we charge the Team price pro rata and credit what you have actually paid for that period. We show you the amount before the change; it is charged immediately to the payment method stored for your subscription, without you entering your payment details again. The end of the term and any cancellation stay as they are; a monthly subscription then renews at the Team price. To go back to Standard, cancel with effect from the end of the term and order again; there is no pro-rata refund for this.
- Free trial: the trial starts when you first launch the software, runs for seven days and costs nothing. It is not a subscription: you enter no payment details, nothing is charged, and it does not turn into a paid plan — after seven days it simply ends. There is nothing to cancel. One trial per person and per device. Teams and shared laps (clause 7a) are not part of the trial. If you order while your trial is still running, the remaining trial days are not lost: they are added to your access (on a monthly subscription they take effect at its end).
- Payment is handled by Stripe: by card on the Standard monthly subscription; by card or PayPal on the Team monthly subscription and on the annual pass. If a payment fails, we may suspend access until it succeeds.
How to cancel. In your account at paceguru.net/account.html under "Manage subscription" — this opens the customer portal of our payment provider Stripe, where you can cancel your subscription yourself. Alternatively, simply write to info@paceguru.net; we confirm a cancellation by email in writing.
As a consumer you have a right of withdrawal. Details, and the conditions under which it expires early, are set out in the withdrawal policy.
6a. Refunds
Beyond the statutory rights below, we do not operate a general money-back guarantee — the free trial and the monthly subscription exist so that nobody has to commit to something they have not tried.
- Withdrawal. As a consumer you may withdraw within 14 days and get everything back, unless the right has expired early because you asked us to start straight away and we did. See the withdrawal policy.
- Faults. If PaceGuru does not do what it is supposed to do, you have the statutory rights for digital products (§§ 327 ff. of the German Civil Code): we fix it, and if that fails you can reduce the price or end the contract and get your money back for the part you could not use.
- Charged by mistake. If we charge you after a cancellation, or twice, write to us and we refund it — no discussion, and without you having to rely on any of the above.
- Refunds go back the way you paid, normally within fourteen days.
- Effect of a refund. If we refund a payment in full, what was paid for with it ends immediately: for the payment for changing to the Team plan, your subscription continues as Standard; for a purchase or renewal payment, the subscription or annual pass and the access paid for with it end. A partial refund does not change your contract. You receive an email about this.
- Chargebacks. If you have a payment reversed through your bank or PayPal, we treat this like a full refund from the moment the case is opened. If it turns out that the payment stays with us, we restore the service when you write to us.
7. System requirements and availability
PaceGuru requires Windows, an installed and working copy of iRacing, and an occasional internet connection for the licence check. If the licence server is temporarily unreachable, PaceGuru continues to run offline for a limited period.
We aim for high availability of our services but do not owe any particular level of availability. Maintenance, third-party outages and changes to iRacing may temporarily limit usability.
7a. Teams and shared laps
With a subscription or annual pass you can join teams and share laps with their members; this is included in both plans at no extra cost. To open and run a team of your own you need the Team plan (clause 5) or a Team plan code. You can run one team of your own per account; the number of members is not limited, and members only need the Standard plan. Teams are not part of the trial. The following applies:
- Your own driving only. You share only laps you drove yourself. You do not upload other drivers' recordings.
- No third-party data. Display names and team names must not identify another person, impersonate anyone, or be offensive or unlawful. Your display name is a name of your choice and need not be your iRacing name. If you save one, the members of every team you are in, or join later, see it; if you empty the field, you appear anonymous everywhere.
- What is shared. An excerpt of the driving data is uploaded, without setup, without iRacing name and without iRacing ID; the details are in the privacy policy. The format must not be altered to store other content.
- Use by the team. By uploading you allow the members of that team to load and use the lap as a reference in PaceGuru, and allow us to store it and deliver it to those members for that purpose. We receive no further rights. The permission ends once the lap is deleted.
- Administration. Whoever creates a team administers it: invites, roles, who may upload and delete laps, and deleting the team including all its laps. Pass invite codes only to people who are meant to join the team.
- Storage. Each team has a limited quota; the app shows the current limits. There is no entitlement to more.
- Not an archive. Shared laps are a working copy for the
team, not a replacement for your own recordings. Keep your
.ibtfiles yourself. Other members can delete laps according to the team's rules. - Team without the Team plan. If your right to run a team ends – because the Team plan runs out, a Team plan code expires or your subscription ends altogether – your team stays unchanged for three days. After that it is read-only: members can still load the shared laps, but nobody can share new laps, invite or join. 30 days later we delete the team including all laps shared in it. We notify you twice by email beforehand. If you regain the right before then, or hand the team over, it is fully usable again at once and nothing is deleted.
- Handover. You can offer your team to a member in the app. If they accept within seven days, the team passes to that member with all its laps. A member can accept if they are entitled to run a team themselves and do not run one yet.
- Existing teams. Teams created before the Team plan was introduced can be continued without that plan, permanently and at no extra cost; for them the three-month rule in the next item applies instead of the 30-day rule. This protection ends when the team is handed over. In addition, accounts that had a paid subscription or a paid annual pass on 6 October 2026 may permanently open and run a team of their own without the Team plan, for as long as their account has running access.
- End of subscription. Without an active subscription, your shared laps in other people's teams and a team with the protection above remain for three more months. After that we delete those laps and that team, including all laps in it. We notify you twice by email beforehand. If you subscribe again before then, nothing is deleted. Leaving a team, removing your display name and deleting your own team remain possible without a subscription.
- Violations. We may remove content that violates these rules or applicable law; in case of a serious or repeated violation we may block the team feature for the account. Reports to info@paceguru.net.
8. Changes to the software
We continue to develop PaceGuru. Changes that go beyond what is needed to keep PaceGuru in conformity with the contract (such as bug fixes and security updates) are made only for a valid reason. Valid reasons are:
- a change to iRacing or its interface that makes a feature impossible to operate, or possible only in a different way,
- requirements iRacing sets for third-party software,
- security or data protection requirements,
- changes in the law, or decisions by authorities and courts,
- the technical development of PaceGuru, such as new or improved features and a changed operating environment.
Such a change does not cause you any additional cost, and we inform you about it clearly and comprehensibly.
If a change negatively affects your access to PaceGuru or its usability, we also inform you by email within a reasonable time beforehand: about the features and the time of the change and about your rights. You may then end the contract free of charge within 30 days. The period starts when you receive the information; if the change is made later, it starts with the change. We refund pro rata what you have already paid for the time after the contract ends. This right does not exist if the negative effect is only minor, or if PaceGuru remains available to you unchanged and at no additional cost (§ 327r of the German Civil Code).
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and within the scope of any guarantee given.
In cases of simple negligence we are liable only for breach of a material contractual obligation — that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract.
Liability is otherwise excluded to the extent permitted by law. Within that limit we accept, in particular, no liability for conclusions you draw from the displayed data, nor for effects on your iRacing rating or race results.
Your statutory rights in the event of defects (clause 6a, §§ 327 ff. of the German Civil Code) and your claims under the General Data Protection Regulation are not affected by this clause.
10. Third-party services
We use Stripe for payments, Cloudflare for delivery of the website, and Brevo for sending email. The software's access check runs against our own server; no third-party licensing service is involved. We are liable for outages or errors of these services only within the scope of clause 9. Which data goes to whom is set out in the privacy policy.
Garage61. The Garage61 connection is an optional additional feature built on Garage61 (garage61.net), a service of another provider; it requires your own Garage61 account, the use of which is governed by Garage61's terms. Which laps and data can be fetched is determined by Garage61 based on your Garage61 account. Garage61 may limit, change or discontinue access; there is no entitlement to the availability of this feature or of particular laps, and the price of PaceGuru does not depend on it. The feature is part of the Team plan (clause 5) and is also available to accounts with a Team code; it is not included in the Standard plan or the free trial. If the Team plan ends, an existing connection is kept, but no laps can be fetched until you have the plan again or disconnect.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
